PalehuiGo Terms of Use (EULA) and Terms of Service

1. Acceptance of Terms
By downloading, installing, accessing, or using the PalehuiGo mobile application (“App”), you agree to be bound by these Terms of Use (EULA) and Terms of Service (“Terms”). If you do not agree, you may not use the App.
These Terms constitute a legally binding agreement between you and Palehui LLC (“PalehuiGo,” “we,” “us,” or “our”).
If you are using the App on an Apple device, you also agree to Apple’s applicable terms and acknowledge that Apple is not responsible for the App or its content.
2. Description of Service
PalehuiGo is a marketplace platform that connects customers (“Clients”) with independent service providers (“Contractors”) for automotive-related services, including but not limited to:
Vehicle detailing
Tire services
Mobile refueling
Oil changes
Battery services
Locksmith services
Towing
Glass repair
Vehicle inspections
PalehuiGo facilitates discovery, communication, scheduling, service request management, and (when enabled) payment processing.
Contractors are independent third parties. They are not employees, agents, joint venturers, or representatives of PalehuiGo. PalehuiGo does not directly perform automotive services.
3. Eligibility and Accounts
To use certain features, you must create an account.
You agree to:
Provide accurate and complete information
Keep login credentials confidential
Be responsible for activity under your account
Notify us of unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Independent Contractor Relationship
Contractors are independent service providers. PalehuiGo does not:
Control how services are performed
Guarantee service outcomes
Employ Contractors
Clients acknowledge that service agreements are between Client and Contractor directly.
5. Completion Confirmation and Payment Authorization
5.1 Dual Confirmation Requirement
For marketplace service payments (when enabled):
A Contractor may mark a service as completed.
The Client must confirm completion before payment is processed.
No charge is initiated until both parties confirm service completion.
This dual-confirmation process is designed to protect both Clients and Contractors.
5.2 Payment Processing
When marketplace payments are enabled:
Payments are processed by a secure third-party payment provider (such as Stripe).
PalehuiGo does not store full credit card information.
By confirming payment, Clients authorize the charge shown in the App.
6. Fees and Platform Charges
PalehuiGo may charge a service/platform fee for facilitating marketplace transactions.
The applicable fee:
Is displayed clearly before payment
May vary based on subscription tier or service type
Is included in the total shown before confirmation
PalehuiGo reserves the right to modify fees with prior notice in the App.
7. Contractor Subscription Plans (Digital Features)
Certain digital features for Contractors are offered through in-app purchases.
These purchases unlock digital tools only (e.g., job visibility, limits, analytics) and do not guarantee earnings.
7.1 Auto-Renewable Subscriptions
If you purchase an auto-renewable subscription:
Payment is charged to your Apple ID at confirmation.
Subscriptions renew automatically unless canceled at least 24 hours before renewal.
Renewal charges occur within 24 hours before the end of the billing cycle.
Subscriptions are managed via Apple ID > Subscriptions.
7.2 Non-Renewing Purchases
Lifetime access (if offered) provides ongoing access to designated digital features and does not guarantee marketplace demand.
7.3 Refunds for In-App Purchases
All App Store in-app purchase refunds are handled by Apple in accordance with Apple’s policies.
8. Cancellations and No-Shows
Unless otherwise stated in the App:
Free cancellation: up to 2 hours before scheduled service
50% charge: within 2 hours
Full charge: no-shows or cancellations after Contractor arrival
Specific services may have additional terms disclosed before booking.
9. Disputes and Refunds (Marketplace Services)
If a dispute arises:
Clients may report an issue in-app.
Payments are not processed until completion is confirmed.
Refund decisions are handled in accordance with platform policy and applicable payment processor rules.
Chargebacks may result in account suspension pending investigation.
PalehuiGo reserves the right to review disputes and take administrative action.
10. Ratings and Reviews
Users may leave ratings and reviews.
You agree that reviews:
Must be honest and not defamatory
May be removed if fraudulent or abusive
May be used for quality monitoring
11. Account Suspension and Termination
We may suspend or terminate accounts for:
Fraudulent activity
Repeated disputes
Harassment or misconduct
Violation of these Terms
We may also block Contractors for safety or quality concerns.
12. User Conduct
You agree not to:
Engage in illegal activity
Submit false information
Attempt to bypass platform payment systems
Interfere with platform security
13. Privacy and Data Use
Use of the App is subject to our Privacy Policy.
The App may collect:
Name, email, phone number
Location data (for service matching and ETA)
Device identifiers
Payment metadata (processed by Stripe or Apple)
We do not store full card details.
14. Disclaimers
THE APP IS PROVIDED “AS IS.”
PALEHUIGO DOES NOT GUARANTEE:
Service quality
Contractor availability
Earnings for Contractors
Continuous, error-free operation
15. Limitation of Liability
To the fullest extent permitted by law, PalehuiGo is not liable for:
Services performed by Contractors
Vehicle damage or loss
Indirect or consequential damages
Lost profits or data
Our maximum liability shall not exceed the total platform fees paid in the preceding 3 months.
16. Indemnification
You agree to indemnify and hold PalehuiGo harmless from claims arising out of:
Your misuse of the App
Your violation of these Terms
Services you perform (Contractors)
17. Governing Law
These Terms are governed by the laws of the State of California.
Disputes shall be resolved in California courts unless mandatory law requires otherwise.
18. Apple-Specific Terms
If you access the App through Apple:
Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support.
In the event of App failure, you may notify Apple for refund in accordance with Apple policy.
Apple and its subsidiaries are third-party beneficiaries of this EULA.
19. Changes to These Terms
We may update these Terms from time to time.
If material changes occur, we will update the “Last Updated” date and may notify users in-app.
Continued use after updates constitutes acceptance.
